Remember that the additional right must be filed within one year of the decision. The main advantage of this trail is that it allows the Veteran to submit new evidence, whereas a higher audit does not. If the claim is rejected again, the Veteran will still have all three options. As mentioned in 38 U.S.C§ 7105(b)(1), the postmark determines the filing date. As long as the NOD is postmarked on or before the expiry of the one-year period, it shall be considered appropriate. The calculation of the time takes into account the first day and the last day. As with many other registration deadlines in other locations, the deadline if the due date follows a Saturday, Sunday or legal holiday would be the next business day. See 38 C.F.R. § 20.305 (b).
